Registration
To register to make use of the services, a user must complete the registration process and must provide SMS Warehouse with up-to-date, complete and accurate information as requested by SMS Warehouse. Failure to provide accurate and complete information on registration may result in termination of the services. A user may also be required to choose a username and password. Users undertake not to divulge their username and passwords to any other person. A user is entirely responsible for any and all activities. Users shall be strictly liable to make payment of all charges incurred under their account whether or not these charges are incurred by the user or any other person, authorised or unauthorised, intentionally or unintentionally, or as a result of any virus, hack or security breach.
Account activation
We request financial information from the user for our credit purchase. Here the user must provide financial information (credit or debit card number and expiration date). This information is used for billing purposes only and is not stored for any other reason by SMS Warehouse.
Security
Users are responsible for maintaining the security of their account, and are solely responsible for all activities that occur in regards to that account. The user agrees to notify SMS Warehouse of any unauthorised use of the account as well as any other security breaches. SMS Warehouse cannot and will not be liable for any loss or damage from user negligence.
The user acknowledges and agrees that under no circumstances will SMS Warehouse be liable in any way for any acts or damages of any kind incurred as a result of users not following security procedures. The use of SMS Warehouse to send abusive messages can be traced to the originator upon request from the police and this user will be liable for prosecution under the 1988 Malicious Communications Act. SMS Warehouse is not responsible for content of messages sent by users of the service. SMS Warehouse will co-operate with official inquiries into misuse of our services. By using this service you agree to be bound by our terms and conditions. SMS Warehouse may change these terms and conditions at any time, and these shall become effective immediately upon posting to this page.
Payment and prices
Network service providers’ charges for use of their networks and for SMS and other related services may differ in respect of individual network operators and may be varied by network operators from time to time and without prior notice to SMS Warehouse or its users. SMS Warehouse may vary its charges for SMS messages from time to time and without prior notice to users. In the event that a network(s) introduce reciprocal charges, SMS Warehouse retains the right to increase the number of credits needed per message, for that specific network(s).
Payment security
SMS Warehouse uses the secure third party payment gateways of Google Checkout, PayPal, and Interswitch. The users have the right to review, correct and cancel electronic transactions before the user effects payment and/or place an order. Credits purchased using a credit and debit card will expire within 3 months of the date of purchase.
The number of credits used per message depends on the destination and the messaging route used. This number is subject to change without notice, and is indicated on the "coverage" link. The cost of a credit consists of the message cost (network operator), database, user care and handling cost.
One SMS Warehouse credit allows you to send one SMS message to some destinations and more in some cases to other destinations (this depends on the routing), provided that networks do not introduce reciprocal charges (in case of short codes for mobile voting competitions). The cost of a credit consists of the message cost (network operator), database, user care and handling costs.
Without prejudice to any other right that it may have in law, SMS Warehouse shall have the right to suspend or disable the operation of any user account and the provision of services to any user where payment of all charges have not been made in full by the due date, or where SMS Warehouse reasonably suspects that payment has been made or effected by fraudulent means.
Returns and refunds
The procedures set out are used here to return an item and do not affect your right to reject faulty goods.
Returning
If you wish to return goods, you have a duty to keep them in your possession and to take reasonable care of them until you return them. Please fill in the return slip and post it back to us. Postage and packaging is handled by a third party company, so refund does not apply to postage and packaging.
Refunds will be credited within 5 – 7 working days. Goods must be returned in its original condition, including immediate packaging, within 14 working days. Our returns policy does not affect your statutory rights.
Services
The delivery of SMS, MMS and video clips is largely dependent on the effective functionality of network operators’ cellular networks, network coverage and the SMS, MMS and video clips recipient’s mobile handset. SMS Warehouse cannot guarantee the availability of the service or delivery of SMS, MMS and video clips. SMS Warehouse shall make all reasonable endeavours to ensure uninterrupted and continued use of the service.
Network operators may modify, enhance, develop or discontinue components of their services at any time without prior notice, in which event SMS Warehouse shall be entitled to modify, enhance, develop or discontinue its services to users without notice.
SMS Warehouse shall use reasonable endeavours to provide the user with advance notice of any modification, suspension or termination of its services and shall endeavour to minimise the duration of any suspension thereof in so far as this is reasonably practicable.
SMS Warehouse reserves the right to change or terminate the services and/or alter these terms and conditions for provision of the service at any time.
Messages shall be deemed to have been delivered when SMS Warehouse has sent the messages to the immediate destination that it is requested to do including, but not limited to, mobile telephone networks, SMTP or other servers.
PRIVACY POLICY
Internet user privacy is of paramount importance to SMS Warehouse. Our goal is to maintain the trust of our users and others who visit our website.
